U-List Real Estate - Terms of Service
Welcome to U-List Real Estate. By creating an account, accessing the portal, or using our services, you agree to the following Terms of Service. Please read them carefully before proceeding.
1. About U-List Real Estate
U-List Real Estate (“Company,” “we,” “our,” or “us”) is a licensed Georgia real estate brokerage that provides property listing services through a flat-fee, self-service model. We empower sellers to list properties on the Multiple Listing Service (MLS) and related platforms while maintaining control of their own selling process.
2. Eligibility
To use our services, you must:
- Be at least 18 years old;
- Be the legal owner of the property being listed or have authorization from the owner;
- Provide accurate and complete information when creating your account and submitting your listing.
3. Services Provided
Depending on the plan you select, services may include:
- MLS listing input and updates;
- Document templates (e.g., contracts, disclosures);
- Tools for scheduling showings and managing offers;
- Optional Broker Support advisory services.
Important: None of our current plans provide full brokerage representation. Sellers remain responsible for all communication, negotiations, and transaction management.
- Standard Plans (Just List, List Smart): You are considered a customer, not a client. U-List Real Estate provides tools, resources, and MLS access but does not represent you as a fiduciary.
- Broker Support Plan: You may receive guidance and advisory support. However, you remain responsible for negotiating directly with buyers and buyer’s agents and managing the transaction.
4. Customer Responsibilities
By using our platform, you agree that you are solely responsible for:
- Responding to inquiries, showing requests, and offers;
- Negotiating directly with buyers and their agents;
- Complying with all applicable real estate laws, including Fair Housing laws;
- Providing accurate information and required disclosures;
- Maintaining your account security and password.
5. Listing Agreements, Billing & Cancellations
Georgia law requires all listing agreements to have a defined start and end date. For that reason, all U-List listing agreements are for an initial period of 6 months.
- Upfront Payment: Services are provided for a one-time, non-refundable fee based on the plan selected at the time of purchase. Current pricing is displayed on the U-List Real Estate website and/or within the customer portal.
- No Monthly Billing: There are no recurring monthly charges for the initial listing term.
- Expiration & Renewal: Prior to expiration, you will be notified and may choose to extend your listing for an additional term under a new agreement.
- Cancellation: You may request to cancel your listing at any time unless the property is currently under contract. All fees paid are non-refundable.
- Pending Status at Expiration: If the property is under contract and in Pending status at the time the listing term expires, the listing will remain in Pending status in the MLS until the transaction closes or the contract is terminated. The listing will not automatically renew, and no additional fees will be incurred during this time.
- Closing: Once your property closes, your listing agreement is considered complete and no further obligations apply.
- No Refunds: No refunds will be issued for unused time, early cancellation, or sale of the property prior to the end of the listing term.
Seller acknowledges that once the property is under contract, the listing cannot be canceled or removed from the MLS until the contract is terminated or the transaction closes.
6. Ownership Verification
We may verify property ownership through public tax records. If your name does not match the record, you must provide proof of authorization to advertise the property. Listings submitted without proper authority may be removed.
7. Compliance & Prohibited Use
You may not use our services to:
- Post inaccurate, misleading, or fraudulent property information;
- Violate Fair Housing laws or other applicable laws;
- Harass, defraud, or misrepresent yourself to buyers, agents, or other users.
Violations may result in immediate suspension or termination of your account without refund.
8. Disclaimer of Representation
U-List Real Estate does not represent you as an agent or fiduciary unless a separate written agreement explicitly states otherwise. You are self-represented and assume responsibility for all negotiations, decisions, and transaction management.
9. Limitation of Liability
To the fullest extent permitted by law:
- U-List Real Estate is not liable for any damages arising from your use of the portal or services;
- We do not guarantee a sale, number of leads, or specific results;
- You agree to indemnify and hold us harmless from claims related to your use of our services or property listings.
10. Changes to Terms
We may update these Terms from time to time. Continued use of the portal after changes are posted constitutes your acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the State of Georgia. Any disputes will be resolved in the courts of Fulton County, Georgia.
